GDPR Privacy Policy

Actindi, Inc ("Actindi") may have occasion to collect and process the Users' (defined in the Terms of service) personal data (defined below). This Privacy Policy applies to the processing of Personal Data concerning the Users in the European Union-member countries and the three EEA/EEA states – Iceland, Liechtenstein and Norway (the "EU").

Article 1. Definition

  1. The term "personal information" as used in this Privacy Policy shall mean information about a living individual which can identify the specific individual by name, date of birth or other description contained in such information(including such information as will allow easy reference to other information and will thereby enable the identification of the specific individual).

Actindi may collect the following personal data from the Users:
  1. Identity Data, including the name, date of birth, gender, the SNS accounts such as "Facebook" or "LINE", username and password;
  2. Contact Data, including telephone numbers, e-mail address, postal address.

Article 3. Purpose of Use

  1. Actindi will use the Users (defined in the Terms of service)' personal data acquired through their use of the Services for the purpose of offering the Services (defined in the Terms of service), including, but not limited to, management the Users, coping with the inquiry, distributing E-mail magazines, distributing advertisements and sending presents.
  2. Actindi relies on the following legal grounds to process personal data:
    1. the Users' consents to the processing of Users' personal data for one or more specific purposes;
    2. for the performance of a contract to which the Users are party or in order to take steps at the request of the Users prior to entering into a contract;
    3. for compliance with a legal obligation to which Actindi is subject.

Article 4. Offering Personal Information to Third Parties

As a general rule, Actindi will not offer personal information on our users to third parties without the users' (owner's) consent. However, there may be exceptions to the following cases:

  2. in which the provision of personal information is necessary for the protection of the life, body, or property of an individual and in which it is difficult to obtain the consent of the person.
  3. in which the provision of personal information is specially necessary for improving public health or promoting the sound growth of children and in which it is difficult to obtain the consent of the person.
  4. in which the provision of personal information is necessary for cooperating with a state organ, a local government, or an individual or a business operator entrusted by one in executing the affairs prescribed by laws and regulations and in which obtaining the consent of the person are likely to impede the execution of the affairs.

Article 5. Management Entrust

There will be times where Actindi entrusts the handling of personal information Actindi has acquired to others. When Actindi entrusts an individual or a business operator with the handling of personal data in whole or in part, it shall exercise necessary and appropriate supervision over the trustee to ensure the security control of the entrusted personal data.

Article 6. Storage Period

Actindi stores the Users' personal data for as long needed in light of the purpose described in this Privacy Policy. The criteria used to determine Actindi’s storage periods include:
  1. the length of time Actindi have an ongoing relationship with the Users;
  2. whether there is any legal obligation to which Actindi is subject.

Article 7. The Users' Rights

  1. The Users have the right to request from Actindi disclosure of, access to and rectification or erasure of personal data or restriction of processing concerning the Users as well as the right to data portability.
  2. The Users have the right to object to processing of personal data concerning the Users which is based on legitimate interests, including profiling.
  3. In so far as personal data processing is based on consent, the Users have the right to withdraw consent at any time.
  4. If the Users make requests such as for disclosure of the personal date from Actindi, contact Actindi from the following contact details for inquiries. Actindi will answer the requests such as for disclosure of any personal data made from the Users immediately in accordance with Actindi's personal data disclosure rule.

Article 8. The Users' Rights to complain to a supervisory authority

In addition to the above-mentioned rights, the Users have the rights to lodge a complaint with a supervisory authority, in particular in the EU Member State of your habitual residence, or place of work, or in the place where the alleged infringement of the GDPR took place.

Article 9. Arbitrariness

The Users may decide whether to offer their personal data or not. However, Actindi shall not provide the Services in the purpose listed in Article 3 when required personal data is not offered.

Article 10. The acquisition of the personal data by the method that the Users are hard to recognize

  1. Actindi may save the Cookies of BetterDays to the Users' computers and refer it.
  2. The company which displays an advertisement within BetterDays web page and the Services of BetterDays ("the Advertiser") may save the Cookies to the Users' computers and refer it. In this case, the Advertiser uses the Cookies in accordance with their Privacy Policies. The Advertiser and other companies cannot refer the cookies of BetterDays.
  3. Actindi collects the information such as the Cookies, the environment, and reading history of web pages of the Users' from the browsers of the Users automatically and analyzes it for the purpose of improving the quality of the Services. The partner company which Actindi consigned the advertisement delivery to ("the partner company") may place advertisements in BetterDays. In this case, if Actindi consents, the partner company may acquire the Cookies of the Users and use it in accordance with their Privacy Policies and the partner company never offers the Cookies to Actindi.
    The advertisements the partner company delivers include Behavioral Targeting Advertisements using the action history information that the partner company collected from the website except BetterDays.

Article 11. Language

If there is any contradiction between what the English version of this Privacy Policy says and Japanese language version says, then the Japanese language version shall take precedence.
